Covenants and Other HOA Regulating Documents

Articles of Incorporation, By-Laws, Deed Restrictions, and Amendments of Three Meadows Phase III

 

All properties located in deed restricted communities in Florida are regulated by Florida State Statutes, and certain documents which are recorded in the county or city they are located in. When conflicting regulations exist, the order of priority is as follows:

  1. Florida State Statutes – Regulate the activities of all HOAs in certain areas
  2. Covenants and Restrictions – Provide basic HOA operating processes and restrict the property use rights of homeowners
  3. Articles of Incorporation – Usually have limited basic terms which existed at the date the corporation was established and may quickly become out of date
  4. By-Laws – Provide more detailed rules which govern the actual operation of the HOA in daily affairs, but do not specifically restrict property use

Complete Current Governing Documents

Oftentimes, these documents are misplaced or not properly provided when a home is purchased. Attached here is one file which includes all 3 governing documents as recorded for all the Phase III as a downloadable .pdf file. These are the current regulating documents as of January 1, 2022. Although the By-laws are currently a topic of concern for the 2022 Board, the document here is the version we have been governed by for the past 30 years. Remember: There’s been much discussion regarding proposed changes to our deed restrictions / covenants. The 2022 Board is also determined to change the By-Laws, so this document may be out of date. This page and/or others will be updated with those proposed changes if they occur.
